The CRA disallowed a deductible expense and imposed gross negligence penalties in our client’s case... We filed a notice of objection against the reassessment, but the CRA rejected it. We disagreed with the CRA and appealed to the Tax Court of Canada. The CRA eventually conceded before the Court in the end of a 5-day trial that the expense was wrongly disallowed at the two levels by CRA. But it still contested the penalties. However, the Court agreed with us, allowed the appeal, and CANCELLED the gross negligence penalties as well.

Tax Court of Canada
A taxpayer was audited by the CRA and charged GST/HST. The taxpayer consulted and retained us. We advised... that the reassessment was incorrect, and disputed it through a notice of objection. But the CRA rejected our objection. We disagreed with the CRA and appealed to the Tax Court of Canada. In mid-trial, the CRA admitted its mistake and conceded before the Court that the GST/HST was charged and upheld incorrectly by the CRA. The Court allowed our appeal accordingly.

The CRA audited our client’s business and foreign remittances that our client received over several... years from different sources. We represented and successfully defended our client in the audit. The CRA closed the audit proceedings without charging any taxes.

The CRA audited a corporation and its director. It taxed the director of the corporation for shareholder... appropriation on account of shareholder loans. The director appealed the decision. The appeal was disallowed. We represented the director in the second round of appeal and successfully defended our client. The entire shareholder appropriation and related tax and interest were vacated in full.

Our client was involved in the purchase and sale of multiple properties over a few years. The CRA audited... our client to treat the gain from these transactions as business income or alternatively as taxable capital gain of our client. We successfully pleaded our client’s case with the CRA. They dropped the audit proceedings. No tax was charged on our client.

New Housing Rebate
The CRA disallowed the GST/HST New Housing Rebate to our client on the purchase of a new house... We represented our client and got the full rebate from CRA.

Disallowance of ITCs
Our corporate client was in property construction business. It purchased a property for construction of... house on it. It claimed GST/HST input tax credits (ITCs) on the transaction. The CRA disallowed the ITCs and reassessed our client for GST/HST. We successfully disputed the ITCs disallowance. The reassessment was vacated in full and our client received a refund with interest from CRA.

Building Code Act violation
Our corporate client was prosecuted by the Crown for Ontario Building Code Act violations on two counts... that carried a maximum penalty of $200,000. We successfully defended our client at trial and obtained a not guilty verdict on both counts. For trial judgment click here

We represented our client in the appeal proceedings and successfully defended the acquittal decision obtained at the trial of our client. The Crown’s appeal was dismissed by the court. Our client was denied child and spousal support by our client’s ex-spouse for over two years in their... divorce case. We went to court against the ex-spouse and obtained for our client thousands of dollars in child and spousal support with arrears. We also got for our client thousands of dollars in a costs award against the ex-spouse.

The ex-spouse of our client concealed financial information from our client to deny giving lawful share... of property to our client in their divorce case. We investigated the ex-spouse’s financial situation and uncovered concealment of assets and liabilities. The ex-spouse eventually made property equalization payment to our client many times more than the originally suggested amount. The payment was made through settlement. We even didn’t have to go to court for it for our client.
